1. Overview & Acceptance

By accessing Pop Smoke Media (“PSM” “we,” “our,” or “us”), subscribing to our newsletter, or purchasing any product, you (“you,” “user,” or “customer”) agree to these Terms & Conditions as well as any policies referenced herein. If you do not agree, do not use the Site.

2. Eligibility

You must be 18 years of age or older (or the age of majority in your jurisdiction) to purchase products. By using the Site you warrant you meet this requirement. Minors may use the Site only with a parent or guardian’s consent.

3. Intellectual‑Property Rights

All articles, photos, podcasts, videos, product designs, logos, and code are the exclusive property of Pop Smoke Media and protected by U.S. and international IP laws. No content may be reproduced without written permission.

4. Products & Services

Products are offered “as available.” We may discontinue, limit quantities, or refuse orders at our sole discretion, consistent with industry practice .

5. Order Processing & Payment

Orders are processed once payment clears.

We reserve the right to cancel or limit any order for suspected fraud, resale, pricing errors, or policy violations.

Accurate billing/shipping information is your responsibility.

Domestic & International: We ship worldwide. International shipping is never free and may incur customs duties payable by the recipient.
Delivery Risk: If the shipping address you supply is correct, we assume responsibility for carrier loss/damage until delivered.

7. Customs & Import Fees

International buyers are liable for all customs, VAT, or brokerage charges. Packages refused for unpaid duties may be treated as abandoned; refunds are at PSM’s discretion.

8. Returns & Refunds

Eligibility: Unused, unwashed items returned within 14 days of delivery in original packaging.

Shipping Cost: PSM pays return shipping (domestic & international).

Refund Timing: Credited to the original payment method within 7 – 10 business days of our receipt and inspection.

We reserve the right to deny returns showing signs of wear, abuse, or excessive return frequency.

9. Pricing, Taxes & Availability

Prices are in USD and may change without notice. Sales tax is charged where required. We may correct errors, inaccuracies, or omissions and cancel orders accordingly .

10. Accuracy of Information

Website information is provided “as‑is.” We do not warrant that product descriptions, articles, or other content are error‑free or current.

11. Third‑Party Tools & Links

We provide access to third‑party tools “as available” and disclaim all liability arising from their use .

12. User Conduct

Prohibited activities include unlawful use, harassment, intellectual‑property infringement, spreading malware, scraping, or interfering with Site security.

13. Comments & Submissions

User‑submitted content may be edited, republished, or removed at our discretion without obligation to compensate the contributor .

PSM, its owners, employees, or suppliers shall not be liable for indirect, incidental, punitive, or consequential damages arising from Site use or product purchase, to the fullest extent permitted by law.

18. Indemnification

You agree to indemnify and hold harmless PSM, its affiliates, employees, and partners from any claims, damages, or expenses arising out of your breach of these Terms or misuse of the Site.

19. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to acts of God, pandemic, carrier interruptions, or governmental actions.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
Any dispute arising from or relating to this site, our services, or products shall be brought in the state or federal courts located in the Eastern District of Virginia, and you hereby irrevocably consent to the exclusive jurisdiction and venue of those courts.

21. Severability

If any provision is deemed unlawful or unenforceable, the remainder remains in effect.

We may modify these Terms at any time by posting updates. Continued use constitutes acceptance.
