A Canadian woman is suing an entertainment venue for ejecting her from a Marilyn Manson concert in 2019. Daniella Leis blames the bar for her unceremonious departure, leading to her driving into a house while intoxicated.

Leis’ collision with the house damaged its gas line causing an explosion that destroyed four houses total, injuring seven people. Of those injured, six were emergency response workers.

The incident resulted in damages estimated between $9.8m to $14.7m.

An estimated 100 homes were evacuated as the blaze began to spread. Authorities have stated they believe Leis was driving the wrong way on a residential road when the crash occurred.

In 2021, she pled guilty to four counts of impaired driving resulting in a three year prison sentence.

The battle of legal responsibility

The lawsuit claims Leis became intoxicated at Budweiser Gardens, hence the resulting damage was “caused or contributed to by the negligence, breach of duty, breach of contract” by the venue under the contravention of the Occupiers’ Liability Act or Liquor Licence Act.

Daniella Leis and her father claim Ovation Ontario Food Services served her alcohol while she was visibly too drunk.

They also claim the company should have seen to her safe departure from the venue instead of leaving her unsupervised after Leis was ejected.

Ovation Ontario Food Services has not responded to the allegations. Leis claims the company “put profit above safety.”
