The move follows accusations of war crimes and crimes against humanity in the Gaza Strip and Israel. According to Khan, there are “reasonable grounds” to believe that Netanyahu and Gallant bear criminal responsibility for various alleged crimes, including “starvation of civilians as a method of warfare” and “intentionally directing attacks against a civilian population.” Similarly, the three Hamas leaders are accused of offenses such as “extermination” and “rape and other acts of sexual violence.”
The prosecutor’s decision has drawn strong reactions, with U.S. President Joe Biden condemning it as “outrageous” and emphasizing the lack of equivalence between Israel and Hamas. However, human rights advocates like Louis Charbonneau from Human Rights Watch view the prosecutor’s action as a crucial step towards accountability for atrocities committed in the region.
Legal experts have pointed out the complexity of the situation, noting that the ICC judges may not necessarily agree with the prosecutor's requests. David Bosco from Indiana University-Bloomington highlighted the intricacies surrounding Israel’s conduct regarding humanitarian aid and its alleged use of starvation as a weapon.

Anthony Dworkin of the European Council on Foreign Relations believes that the prosecutor’s move may prompt countries supporting Israel to reassess their military assistance.
